Here is a more complete quote from a typical NOUO.  The reference to a license is just part of their development of the basis for their action.

Following that text the FCC states how that system was non-compliant with Part 15, and goes on with the possible consequences of continuing that operation.

This all seems quite organized and straightforward.

 ...The Commission's records show that no license was issued for operation of a broadcast station on xxx.x  MHz at this location in xxxxx, xx.

   Radio stations must be licensed by the FCC pursuant to 47 U.S.C. S 301.
   The only exception to this licensing requirement is for certain
   transmitters using or operating at a power level or mode of operation that
   complies with the standards established in Part 15 of the Commission's
   rules, 47 C.F.R. SS  15.1 et seq. ...

Referencing a license that cannot exist is illogical.

With respect to member Rich, saying "The reference to a license is just part of their development of the basis for their action" does nothing at all to justify the FCC's language, in fact it is in itself an illogical thing to say.

No disrespect intended, but it leaves the impression that you, Rich, are excusing poor language from the FCC.

And with all due respect, Mr Blare, note your words in this clip from Reply 37 above: the FCC plainly states in its violation notices that "a license is required."

Two points:

1) Those are not the exact words used by the FCC, and therefore should not presented as a direct quote (one enclosed by quotation marks), but regardless,

2) You failed to recognize in your posted replies that almost all FCC NOUOs are based on, and literally describe within them some non-compliance(s) with Part 15.  They are not based on the lack of an FCC license.

Might the conclusions of your posts on this topic be recognized as incomplete/inaccurate, and/or even illogical by reasonable and knowledgable readers?

Mr Blare, I do hope that any possible reply you make to this post shows your recognition of the truth of my comments in this post.

If not, I will post no response to your reply.

Others can make their own decisions about which of us they choose to believe.

It's 4AM and I just woke up in a cold sweat.  I had a nightmare that Carl Blare and Rich were the SAME PERSON.
